Alright, Texas and now Florida are making secessionist noises after The Traitor was shut out by The Supremes. Who is next? Alabama? Idaho? No doubt there will be more such noise, likely within the week. For those contemplating/worrying about Treason, consider the chain of events which will follow any move beyond big talk:
First, any secession movement in a state legislature will only involve Trumpists. Any Democrats will doubtlessly remain loyal. This will matter shortly.
When any elected state official takes office, they swear an oath to uphold the Constitution. This is how they obtain their lawful authority which ordinary folks don’t have. By voting for secession, they violate that oath, thus nullifying their authority. As such, no elected official can legally vote for secession. Those who try it automatically revert to private citizens.
As now private citizens, these ex-lawmakers cannot vote secession, either. Since the Trumpists abdicated their state authorities, the Democrats, who remained loyal, become a rump government, thus the legal authority of the state remains unbroken.
As for the state power sources, such as the National Guard, these can be ordered to support the lawful government, or be taken into Federal service and ordered to stand down. Those units which refuse to obey are guilty of mutiny, and can be disbanded. Then, like any ‘militia’ types who resort to violence, they can be treated as a purely military matter.
As for the state Trumpist party mechanism, they can be declared in rebellion and dissolved; their assets seized, their leaders arrested. Their representatives in DC will have to be purged as well, no doubt to be replaced by loyalists.
We can safely assume any attempt at real secession will evoke a response from the Biden Administration: if he fails to act, it will fatally undermine our democracy. And as much as we hope it doesn’t happen, we must assume there will be at least a few abortive attempts at an uprising. One good (less horrible) thing in all this will be that the first such being slapped down will discourage the rest. They talk a good talk, but the sight of attack helicopters and APCs will give them a rude awakening.
One can only hope for the best.
